State Environmental Planning Policies

What are SEPPs?

SEPPs are State Environmental Planning Policies.  SEPPs have precedence, unless specifically stated otherwise, over all other Environmental Planning Instruments (EPI).

How do SEPPs come to exist?

The Director-General of the NSW Department of Planning may prepare, or the Minister for Planning may direct the Director-General of the NSW Department of Planning to prepare, a draft SEPP with respect to such matters as are, in the opinion of the Director-General or Minister, of significance for environmental planning for the State.  There is a detailed process that must be followed under Part 3 of the Environmental Planning and Assessment Act 1979 to make a SEPP, including the role of the NSW Governor General in making the SEPP a legal document.

Like all other Environmental Planning Instruments and draft EPI, Council is required to consider any relevant SEPP subject to a Development Application.
