Draft Hurstville LEP 2011
Local environmental plans (LEPs) inform planning decisions in local government areas, through zoning and development standards. They control the form and location of new developments, protect open space, environmentally-sensitive areas and employment lands from inappropriate development.
Hurstville City Council is currently preparing a Comprehensive LEP for Hurstville City, which aligns with standards set by the NSW Government to ensure Council's across the State use clear and consistent planning language.
Every council in NSW must have an LEP, which is developed in consultation with the local community and approved by the NSW Minister for Planning and Infrastructure.
Draft Hurstville LEP 2011 is a highly significant document as it will determine the types of development that occur in the local government area for many years to come. It will enable housing targets to be met, encourage job creation, and generally improve the quality of our natural and built environment for future generations.
History
Council resolved to prepare a draft LEP for the Hurstville local government area in accordance with the NSW Government’s Standard Instrument on 23 July 2008.
Because Council commenced this project and obtained authorisation from the Department of Planning and Infrastructure prior to 1 July 2009, the new LEP will proceed under the Environmental Planning and Assessment Act 1979 as in force at 30 June 2009. This means that Council will not be subject to the new "Gateway" plan making process that commenced under the Environmental Planning and Assessment Amendment Act 2008 and Environmental Planning and Assessment Amendment (Plan Making) Regulation 2009 on 1 July 2009.
Timelines
On 18 July 2011, the Department of Planning and Infrastructure issued a section 65(2) Certificate under the Environmental Planning and Assessment Act, 1979 to permit the formal public exhibition of the draft Hurstville LEP 2011. The s.65(2) Certificate contained certain conditions which required changes to the draft HLEP 2011 Maps prior to the public exhibition of the draft LEP.
Council at its meeting on 30 November 2011 considered reports on the draft Hurstville LEP 2011 and the draft Hurstville City Centre LEP 2011 and resolved to endorse both draft LEPs for public exhibition for a period of no less than twenty eight (28) days.
Public Exhibition of draft Hurstville Local Environmental Plan 2011
Hurstville City Council exhibited the draft Hurstville Local Environmental Plan (LEP) 2011 from 23 January to 29 February 2012. To view the documentation that was part of the exhibition processes see Exhibition Folder 1.

All submissions received as part of the public exhibition are currently being reviewed and will be reported to Council for consideration. If the draft LEP being is endorsed by Council, it will be forwarded to the NSW Department of Planning & Infrastructure for approval by the Minister.
Community Consultation
Throughout 2009-2010, Council released a series of Discussion Papers about land use zones, for community feedback. These papers, together with community feedback, have informed the preparation of the Draft Hurstville LEP 2011, and included:
