Hurstville City Centre Commercial Only Core
History
Council resolved on 14 December 2005 to prepare a draft amendment to Hurstville LEP 1994 that defines a business only area within Zone 3(b) City Centre Business Zone which prohibits residential development.
Strategic Context
The Department of Planning and Infrastructure’s Draft South Subregional Strategy identifies Hurstville as a ‘Major Centre’ and specifies certain employment and dwelling targets to be met. The Strategy also identifies as a key direction to “Strengthen Hurstville’s Commercial Centre”. It states that as “Hurstville is experiencing strong residential growth, there is need to protect the commercial centre to ensure sufficient supply of commercial space in the future”.
The creation of a consolidated Commercial Only Core Zone, as part of the Hurstville Local Environmental Plan 1994 (Amendment No. 70), will promote employment generating development within the City Centre close to public transport. This will strengthen Hurstville City’s position as a strategic Major Centre, in line with objectives and targets in the NSW Government’s Sydney Metropolitan Strategy.
Hurstville Local Environmental Plan 1994 (Amendment No. 70)
The Draft Hurstville Local Environmental Plan 1994 (Amendment No. 70) has been approved by the Minister for Planning and Infrastructure and commenced on 5 August 2011. The amendment introduces a new zone, Zone No. 3(d) - City Centre Commercial Core Zone into the Hurstville Local Environmental Plan 1994, which applies to certain land within the Hurstville City Centre that is close to public transport, and will allow only commercial, retail and other services in the City Centre. Residential development will be prohibited in this new zone.
The LEP introduces a new zone into the Hurstville Local Environmental Plan 1994 and does not contain any height and FSR controls. Height and FSR controls applicable to Zone No. 3(d) – City Centre Commercial Core Zone are contained in the Development Control Plan No. 2 – Hurstville City Centre.
The LEP Amendment includes transitional provisions which means that this amendment does not apply to development applications currently lodged with Council within Zone No. 3(d) - City Centre Commercial Core Zone, and not determined before 5 August 2011.
Amendment to DCP No. 2 – Hurstville City Centre
The draft Amendment to Development Control Plan No. 2 – Hurstville City Centre has also become effective from 5 August 2011. This amendment adds references throughout the DCP to the new 3(d) – City Centre Commercial Core Zone, to ensure that the provisions contained in DCP-2, apply to all land in the new 3(d) zone.
